1. Objective
This Prohibited Jurisdictions list sets out the jurisdictions in which eXchange1 does not offer, or may restrict, its products and services due to applicable laws, regulatory licensing requirements, international sanctions, or internal risk management considerations. It also establishes the framework for identifying, monitoring, restricting, and managing customers and transactions connected to such jurisdictions.
2. Scope
This policy applies to:- All prospective and existing individual customers.
- Corporate customers and their Ultimate Beneficial Owners (UBOs).
- Authorized representatives and persons acting on behalf of customers.
- Wallet addresses, payment counterparties, and all transactions conducted through the eXchange1 platform. All products and services offered by eXchange1.
3. Regulatory Framework
This policy is aligned with:- UAE AML/CFT Federal Laws and applicable implementing regulations.
- UAE Capital Market Authority requirements.
- FATF Recommendations
- UN Sanctions Lists
- OFAC and EU Sanctions (where applicable)
4. Jurisdiction Risk Classification
"The jurisdictions listed below, together with any other jurisdictions designated by the Company from time to time, constitute the List of Prohibited Jurisdictions under these Terms. The Company reserves the right to amend, expand, remove, or otherwise modify this list at its sole discretion and without prior notice to reflect changes in applicable laws, regulatory requirements, sanctions programmes, licensing obligations, or the Company's internal risk assessment.
To be eligible to register for an account and use the Company's services, you must not be located in, incorporated or otherwise established in, resident of, a citizen or national of, or operating from any of the following jurisdictions:
- Afghanistan
- Belarus
- Cameroon
- Chad
- China
- Côte d'Ivoire
- Cuba
- Democratic People's Republic of Korea (North Korea)
- Eritrea
- Gabon
- Ghana
- Islamic Republic of Iran
- Myanmar
- Nigeria
- Russian Federation
- Sierra Leone
- Syrian Arab Republic
- Ukraine (including any territories or regions subject to applicable international sanctions or restrictions)
In addition, the Company does not offer its products or services to any person or entity with a U.S. nexus, including U.S. citizens, permanent residents, entities incorporated or otherwise established in the United States, or any person or entity otherwise subject to U.S. jurisdiction.
The above list is not exhaustive. The Company may, at its sole discretion and without prior notice, restrict, suspend, or prohibit access to its products or services for any jurisdiction, country, territory, person, or entity where required by applicable laws, regulations, sanctions, licensing requirements, or the Company's internal compliance, AML/CFT, sanctions, or risk management policies.”
